Modisoft, Inc. and its subsidiaries and affiliates (for the purposes of this Privacy Policy, collectively, “Modisoft”) are committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, transfer, store, retain, or otherwise process your personal information when you interact with us through the Cartzie software application or the Cartzie website at https://cartzie.com/ related to the App (collectively, the “App”).

We reserve the right to update and modify this Privacy Policy from time to time without prior notice, and such changes become effective on the date of issuance, as referenced above. By continuing to use the App, you represent that you have read and understand, and that you agree to be bound by, the most current posted version of this Privacy Policy and Cartzie Application Terms and Conditions. If you do not agree, you should immediately stop using the App.

Information We Collect and How We Use It

We collect certain data, including personally identifiable information (“Personal Information”), through your use of the App. In order to register for the App, you may be required to provide us certain Personal Information, including your full name and contact details. We may also collect and store your user name and password, and your assigned Cartzie member number. You may also choose to provide general demographic information. All of this information is used to provide and improve the App you have requested, to provide you information and updates related to the App, to respond to inquiries and requests.

When you allow via your device settings, Modisoft may also collect your non-specific geolocation data to provide special offers and deals available nearby. When permitted by you, we may also collect and store the precise location of your device when the App is running. This information may be used to help you select your delivery address and to provide more accurate deliveries of your orders.

Modisoft may also automatically collect information about your device and browser, including your IP address and information about your online activities. This information may be used to improve our services and keep them secure, to personalize your experiences, to prevent fraud, and for advertising purposes. You may choose to use or access our services related to the App via a third party site like Facebook and Google. When you link a third party account to Modisoft or log into the App using such an account, we may collect relevant Personal Information necessary to enable our services to access that site and your information contained within it. We also may share your Personal Information with the operator of that site to facilitate or enhance delivery of services to you. The third party site is governed by its own policies and Modisoft shall have no liability or responsibility for the privacy practices or other actions of the site.

We also collect non-identifiable information to compile analytics related to the App and to improve customer service.

Your Personal Information Rights and Choices

Depending on your state of residence, you may be entitled to certain rights related to the collection and processing of your Personal Information. These rights vary by jurisdiction, but may include the right to:

• Know the Personal Information we collect and for what purposes and from what source we collect this Personal Information.
• Know what Personal Information we share, to whom we share, and for what purpose.
• Access, modify, correct, or delete your Personal Information.
• Receive your Personal Information in a format that is easily readable and transferable.

Sharing Information with Third Parties

Modisoft may share your Personal Information with our third-party service providers for certain business purposes such as payment and data processing, customer support and order fulfillment, Website analytics, and IT and other services. These service providers may only access and use your Personal Information for the purpose of performing services on our behalf. In other cases, Modisoft may provide your Personal Data to our rewards partners. In such cases, the partner’s privacy policy will apply.

Modisoft may be required to disclose Personal Information to law enforcement and other agencies to protect and defend our legal rights, to protect the safety and security of our users, to prevent fraud, or to otherwise comply with the law.

In the event of a sale, transfer, merger, reorganization, or dissolution of the business, or other similar event, Modisoft may transfer your Personal Information to another party as part of the transaction.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Cookies

Modisoft may use “cookies” and similar technologies to personalize your online experience. A cookie is a text file that is placed on your device. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are designed as a convenience tool to allow you to tell the server that you have returned to a specific page. You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the App.

Third-Party Sites

Some of the functionality in the App may be provided by third parties, and the App may link to other third-party websites that are not controlled by Modisoft. These websites are not under our control, and Modisoft is not responsible for their privacy policies or practices. If you provide any Personal Information to any third party or through any such third-party website, we recommend that you familiarize yourself with the privacy policies and practices of that third party.

Security

Modisoft has implemented administrative, technical, and physical security controls that are designed to safeguard your Personal Information. However, while we strive to protect your Personal Information, we cannot guarantee that your Personal Information is absolutely secure because there are security and privacy limitations inherent to the Internet which are beyond our control. Please keep this in mind when disclosing any Personal Information to Modisoft, and exercise personal care and responsibility to secure your Personal Information.

International Transfers

Our services are offered from, and your Personal Data will be processed and stored in, the United States. By using the App, you are expressly consenting to any required transfers of your Personal Information from your home country to the United States.

Children’s Data

Modisoft is committed to protecting the privacy of children. Modisoft does not knowingly collect Personal Information from children under the age of 13. If you are under the age of 13, do not provide us any Personal Information. Your parent or guardian must consent to your use of the App.

Do Not Track Disclosure

We currently cannot recognize web browser “do not track” signals. If we do so in the future, we will update our Privacy Policy accordingly. For more information about “do not track,” visit http://www.allaboutdnt.org/.

Retention

Modisoft will only retain your Personal Information for as long as is necessary for the purposes set out in this Privacy Policy. If you no longer want Modisoft to use your Personal Information to provide the App to you, you may close your account. Modisoft will retain and use your Personal Information to the extent necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and as otherwise described in this Privacy Policy. We also retain log files for internal analysis purposes, including site safety and functionality.

Special Notice to California Residents

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your Personal Information by Modisoft to third parties for direct marketing purposes.
